How the Bankruptcy Affects Consumers
At this time, consumers are not required to file any claims with the bankruptcy court or the Chapter 11 Trustee.
API sold vehicle service contracts to approximately 330,000 individual consumers throughout the United States. These contracts were sometimes referred to as an "extended warranty" or "Vehicle Service Contract" or "VSC" for the automobile. The companies that issued the contract sold by API were supposed to be insured by one of the following insurance companies: (i) Travelers Insurance Co./Gulf Indemnity ("Travelers/Gulf"); (ii) First Colonial Insurance Company (“First Colonial”) ; (iii) Northbrook Indemnity Company (“Northbrook”); (iv) Ohio Indemnity Company ("Ohio Indemnity"); and (v) Marathon Financial Insurance Company, Inc. RRG ("Marathon"). In addition certain API contracts were sold as part of the Military Installment Loan Education Services (“MILES”) program.
HOW THE BANKRUPTCY WILL AFFECT YOU depends on the insurance company that insured the issuer of your API contract. If you are uncertain as to the relevant insurance carrier, below are links that will enable you to determine the insurance company involved, and how each insurance carrier will continue to handle claims under your API contracts.
