TO ABANDON DEBTOR’S BOOKS AND RECORDS
INITIAL HEARING DECEMBER 2, 2008
The Trustee is asking the Bankruptcy Court to enter an order authorizing the Trustee to abandon approximately 2,800 boxes of documents located at the offices of Automotive Professionals, Inc. (“API”) and at a storage facility maintained by API. The documents the Trustee seeks to abandon include old sales contracts, promotional material and other documents the Trustee has determined are not necessary to administer the bankruptcy case. The hearing is scheduled for December 2, 2008 at 10:30 a.m.

TRUSTEE'S THIRD MOTION TO APPROVE UNITED CAR CARE, INC. SETTLEMENT AGREEMENT SCHEDULED FOR OCTOBER 30, 2008
The Trustee has filed a motion seeking to approve a settlement agreement with United Car Care, Inc., as agent for the following dealers. This motion is set for hearing on October 30, 2008 at 10:00 a.m.
If the settlement agreement is approved by the Bankruptcy Court, all valid repair costs will continue to be paid pursuant to the terms of the vehicle service contracts sold by these automobile dealers. Guaranteed Price Refund Claims are not provided for under any settlement agreements proposed by the Trustee, such claims can be asserted directly against API's bankruptcy estate. The Bankruptcy Court has not set a deadline for filing any claims, including Guaranteed Price Refund Claims against Automotive Professional, Inc.

The Trustee has filed a motion seeking to approve a settlement agreement with Almatterese Investments, LLC. This motion is set for hearing on October 30, 2008 at 10:00 a.m. Almatterese Investments, LLC has selected Courtesy Insurance as its new insurer.
If the settlement agreement is approved by the Bankruptcy Court, all valid repair costs will continue to be paid pursuant to the terms of the vehicle service contracts sold by these automobile dealers. Further, Guaranteed Price Refund Claims are provided for under the settlement agreement.

On September 23, 2008 at 10:00 a.m., the Bankruptcy Court approved a
settlement agreement with Automotive Onalaska, Inc. and Dahl Ford La Crosse, Inc. Automotive Onalaska, Inc. and Dahl Ford La Crosse, Inc. have selected Universal Underwriters Insurance Company, a division of Zurich Insurance, to handle claims. UNCLAIMED FUNDS PURSUANT TO TRAVELERS SETTLEMENT AGREEMENT
On October 30, 2007, the Bankruptcy Court approved the Settlement Agreement that the Trustee reached with The Travelers Indemnity Company ("Travelers"). Pursuant to the Settlement Agreement, Travelers will continue to process and pay valid repair claims under Vehicle Service Contracts that are still in force and backed by Travelers. Please click

On November 20, 2007, the Trustee sent letters to all automobile dealers regarding disbursements of funds.
As of October 1, 2008, nearly 600 DEALERS have not forwarded the necessary paperwork to the Trustee to claim their disbursements. If these Dealers do not claim these funds within the next 60 days, those funds may be forfeited to the API Bankruptcy estate. If you are a dealer on one of these two lists and want to claim your disbursement, please contact the Trustee.

UPDATE (11/21/2007) NEW CONTACT NUMBER FOR MARATHON FINANCIAL SERVICES, INC. CLAIMS
Effective on December 10, 2007, consumers and dealers will need to call 1-800-682-9738 or fax 1-800-682-9142 to make a claim for Marathon-backed vehicle service contracts. These new contact numbers are to be used for vehicle service contracts issued by an automobile dealer in any of the following states: Texas, Illinois, North Carolina, Nebraska, Oregon, Utah, Virginia, and Washington.
There is currently no process for handling claims for Marathon-backed vehicle service contracts in any of the remaining states.

Chapter 11 Case Administration Website

On April 13, 2007, Automotive Professionals, Inc. (the "Debtor" or "API") filed a voluntary petition for reorganization under Chapter 11 of the Bankruptcy Code with the United States Bankruptcy Court for the Northern District of Illinois, Eastern Division (the "Bankruptcy Court"). The case has been assigned to the Honorable Carol A. Doyle as Case No. 07-B-06720.
On June 12, 2007, the Bankruptcy Court appointed Frances Gecker, an independent third party, to be the Chapter 11 Trustee for API (the "Chapter 11 Trustee"). The bankruptcy process will enable the Chapter 11 Trustee to propose a plan which will pay API's creditors from API's assets obtained and liquidated by the Chapter 11 Trustee.
This website will contain regular updates as to the status of the case, including: (i) answers to frequently asked questions; (ii) Notice of Commencement; and (iii) copies of court documents. As there are more than 300,000 consumer creditors involved and a limited number of people available to personally answer detailed questions, the Chapter 11 Trustee asks that all creditors review all the information and the documents contained on this website, prior to contacting the Chapter 11 Trustee or any other party currently involved in this case.
